By using the Welcome2France site, application, and/or services, you agree to comply with and be legally bound by provisions in the Terms of Service (“Terms”), whether or not you decide to register as a user. These Terms govern your access to, stay on, and usage of this Website, as well as the applications, services, collective content (as defined below) herein, and, as such, constitute a binding legal agreement between you and Welcome2France. These Terms also govern your participation in the Referral Program (as defined below) and, as such, constitute a binding legal agreement between you and Welcome2France.

If you do not agree to any or all of the conditions and provisions in these Terms, please do not use the Welcome2France site.

Overview

Before using Welcome2France, please read the Terms of Use below. If you continue using our Website, it means that you agree to each and all of the terms, conditions, and provisions listed below.

Welcome2France provides, operates, and maintains an online platform (collectively, “Services”) that connects hosts, who provide accommodations to be booked, with guests desiring to book these accommodations. These Services are available on https://www.Welcome2France.com and as well as other Websites (collectively, “Site”), as well as all applications and application program interfaces for mobile, tablet, and any other smart devices (collectively, “Application”) that Welcome2France operates for the purpose of delivering the Services.

All payment services transacted through Welcome2France Payments, for the purpose of delivering the Services between hosts and guests, are subject to the Payments Terms of Service (“Payments Terms”).

You understand and agree that Welcome2France is not a party to any arrangements or agreements made verbally or in writing between the hosts and the guests. You understand and agree as well that Welcome2France is not a real estate broker, agent, or insurer. You further understand and agree that Welcome2France has no control over the conduct of the hosts, the guests, or the users of the Site, Application, and Services. Thus, Welcome2France expressly disclaims all obligations and liabilities in this regard, to the maximum extent that the law permits.

Definitions

“Accommodation” refers to residential and other real estate property types listed for rent on the Site.

“Booking” refers to the limited license that a Host grants to a Guest to use the Listing for a specified, limited duration, upon Guest payment and Host confirmation, and in accordance with the agreement signed between the Host and the Guest. A “Booking” is determined and confirmed at the sole discretion of Welcome2France. “Booking” is used interchangeably with the terms “Short-Term Rental” and “Home Sharing.”

“Booking Request” refers to a Guest’s expression of intention, made through the Site, Application, or Services, to book an Accommodation with a Host through Welcome2France.

“Booking Request Period” is the period that starts from the time a Guest requests a Booking for a Listing, until such time as the Host decides on the request. Welcome2France reserves the right to determine the validity of a Booking Request, and the Host reserves the right to confirm or deny the Guest request. Booking Request Periods vary according to location, as well as certain internal and external factors.

“Collective Content” refers to both Welcome2France Content and Member Content.

“Communication” refers to messages from or to Welcome2France, the Host, the Guest, and/or other related parties, as sent via e-mail, text, the Application, or a WeChat account.

“Content” refers to text, graphics and other image types, photographs, music, audio, video, software (excluding the Application), and information and other materials presented in various forms on the Site.

“Guest” refers to a Member who uses the Site, Application, and Services to request a Booking of a Listing from a Host. “Guest” also refers to a Member staying at an Accommodation, who is not the Host for that particular Accommodation.

“Home Sharing” is used interchangeably with “Booking” and “Short-Term Rental.”

“Host” refers to a Member who creates a Listing on the Site, Application, and Services.

“Listing” refers to an Accommodation made available by the Host for Booking by a Guest through the Site, Application, and Services.

“Member” refers to a person who creates a Welcome2France account and completes the registration process. A “Member” includes, but is not limited to Hosts and Guests, as described in “Account Registration” below.

“Member Content” refers to all Content that a Member creates and subsequently submits to, posts on, publishes in, and makes available in their account, profile, Listing, or Welcome2France promotional campaign. “Member Content” includes Content that a Member transmits to and through the Site, Application, and Services.

“Short-Term Rental” is used interchangeable with “Booking” and “Home Sharing.”

“Welcome2France Content” refers to text, graphic, photographic, multimedia, and other forms of content that Welcome2France provides through the Site, Application, Services, official social media channels, and promotional campaigns, including content that has been lawfully obtained and licensed from any third parties, but excluding Member Content.

“Tax” or “Taxes” refers to any sales tax, value-added tax (VAT), goods and services tax (GST), transient occupancy tax, tourist or visitor tax, accommodation or lodging tax, and/or other taxes and fees (eg, convention center fees) that Hosts and other types of Accommodation providers may be required by law to collect from Guests and subsequently remit to governmental agencies, from municipal and state to federal or national. “Tax” or “Taxes” may also refer to any indirect or other withholding taxes, as well as personal or corporate income taxes, assessed in relation to transactions between Hosts and Guests with respect to Bookings and Listings.

IF YOU CHOOSE TO CREATE AND MAINTAIN A LISTING ON WELCOME2FRANCE, YOU COMPLETELY UNDERSTAND AND FULLY AGREE THAT YOUR RELATIONSHIP WITH WELCOME2FRANCE IS LIMITED TO BEING A MEMBER AND AN INDEPENDENT THIRD-PARTY CONTRACTOR. YOU COMPLETELY UNDERSTAND AND FULLY AGREE AS WELL THAT YOU ARE NOT AN EMPLOYEE, AGENT, PARTNER, OR JOINT VENTURER OF WELCOME2FRANCE, AND THAT YOU ARE ACTING EXCLUSIVELY ON YOUR OWN BEHALF AND FOR YOUR SOLE BENEFIT, AND NOT ON BEHALF OR FOR THE BENEFIT OF WELCOME2FRANCE. WELCOME2FRANCE DOES NOT CONTROL, AND HAS NOT RIGHT TO CONTROL, ANY OR ALL OF YOUR LISTING/S, OFFLINE ACTIVITIES IN RELATION TO YOUR LISTING/S, OR OTHER MATTERS PERTAINING TO THE LISTING/S YOU PROVIDE TO THE SITE, APPLICATION, AND SERVICES. AS A MEMBER, YOU ABSOLUTELY AGREE NOT TO ENGAGE IN ANY ACT THAT CREATES A FALSE OR WRONG IMPRESSION OF YOU BEING ENDORSED BY, PARTNERING OR JOINT-VENTURING WITH, OR ACTING ON BEHALF OF OR FOR THE BENEFIT OF WELCOME2FRANCE. AS A MEMBER, YOU ABSOLUTELY AGREE NOT TO USE ANY INTELLECTUAL PROPERTY OF WELCOME2FRANCE INAPPROPRIATELY AND WITHOUT EXPRESS WRITTEN PERMISSION.

BY ACCESSING AND/OR USING THE SITE, APPLICATION, OR SERVICES, OR BY DOWNLOADING, USING, OR POSTING ANY CONTENT FROM OR ON THE SITE, THROUGH THE APPLICATION OR THE SERVICES, AND WHETHER OR NOT YOU HAVE REGISTERED WITH THE SITE AND THE APPLICATION, YOU INDICATE THAT YOU ACKNOWLEDGE AND CONFIRM THAT YOU HAVE READ AND UNDERSTOOD THESE TERMS, AND THAT YOU AGREE TO BE BOUND BY THESE TERMS AND RECEIVE OUR SERVICES (SUCH AS, WHERE APPLICABLE, THE HOST PROTECTION INSURANCE PROGRAM).

IF YOU DO NOT, IN PART OR IN FULL, AGREE TO THESE TERMS, THEN YOU HAVE ABSOLUTELY NO RIGHT TO ACCESS AND/OR USE THE SITE AND THE APPLICATION, AS WELL AS WELCOME2FRANCE SERVICES AND/OR COLLECTIVE CONTENT.

If you acknowledge, accept, and agree to these Terms on behalf of a company, establishment, or other legal entity, you represent and warrant that you have been duly given the authority to bind that company, establishment, or other legal entity to these Terms. In such event, “You” and “Your” will apply to that company, establishment, or other legal entity.

Eligibility

The Site, Application, and Services are intended and operated solely for persons who are 18 years old or older. Any form of access to or usage of the Site, Application, or Services by any person under 18 years old is expressly prohibited. Whenever you access or use the Site, you represent and warrant that you are 18 years old or older.

For users in the United States, Welcome2France will, to the extent permitted by any or all applicable laws, and if there is sufficient information on a user’s identity, strive to obtain from public records and Welcome2France vendors the necessary reports on any or all criminal convictions or sex-offender registrations involving the user. For users outside the United States, Welcome2France will, to the extent permitted by any or all applicable laws, and if there is sufficient information on a user’s identity, strive to obtain from public records and Welcome2France vendors the necessary reports on any or all criminal convictions or sex-offender registrations involving the user. You, therefore, authorize us to use your personal information, such as your full name and date of birth, in obtaining such reports and records.

How the Site, Application, and Services Work

The Site, Application, and Services can be accessed and used to facilitate the entry of Listings and the booking of Accommodations. Accommodations are provided by Hosts under the “Listings” tab on the Site, Application, and Services. You may view Listings even as an unregistered visitor of the Site, Application, and Services, but if you wish to enter a Listing or book an Accommodation, you must first create an account and confirm your status as a Welcome2France Member, as described in “Account Registration” below.

As stated above, Welcome2France provides, operates, and maintains an online platform or marketplace with appropriate technology, for Hosts and Guests to connect directly and arrange for Bookings of Accommodations pertaining to the Listings made available on the Site, Application, and Services. Welcome2France is not an owner, manager, caretaker, or operator of properties, including, but not limited to single- and multi-family homes, hotel rooms, motel rooms, and other types of lodgings, dwellings, or Accommodations. Welcome2France does not own, sell, resell, furnish, refurbish, renovate, rent, re-rent, lease out, and/or control the properties listed as Accommodations, and it does not provide, contract, and/or subcontract any transportation or travel services. Unless explicitly specified otherwise in the Site, Application, or Services, Welcome2France has responsibilities limited to facilitating the connection between Hosts and Guests, with respect to booking Accommodations directly with each other.

PLEASE NOTE THAT WELCOME2FRANCE OPERATES THE SITE, APPLICATION, AND SERVICES THAT ARE, AS STATED ABOVE, INTENDED SOLELY TO FACILITATE THE CONNECTION BETWEEN HOSTS AND GUESTS, WITH RESPECT TO BOOKING ACCOMMODATIONS DIRECTLY WITH EACH OTHER. WELCOME2FRANCE CANNOT AND DOES NOT CONTROL THE CONTENT IN THE LISTINGS OR ACCOMMODATIONS. WELCOME2FRANCE ALSO CANNOT AND DOES NOT CONTROL THE CONDITIONS, LEGALITY, OR SUITABILITY OF ANY LISTING OR ACCOMMODATION. WELCOME2FRANCE CANNOT BE HELD RESPONSIBLE FOR, AND DISCLAIMS ANY AND ALL LIABILITY RELATED TO, ANY AND ALL LISTINGS AND ACCOMMODATIONS. ACCORDINGLY, ANY BOOKINGS MADE AND/OR ACCEPTED ARE AT EACH AND EVERY MEMBER’S OWN RISK.

Account Registration

To access certain features of the Site and the Application, to create a Listing, or to book an Accommodation, you must first register an account (“Welcome2France Account”) and become a verified Member. You may register through the Site, the Application, or channels described in this section.

You may also register for a Welcome2France Account via the Site or the Application using your account with certain third-party social networking sites (“SNS”), such as Facebook, and each such account will be a “Third-Party Account”. As a functionality of the Site, Application, and Services, you may link your Welcome2France Account with Third-Party Accounts by either: (i) providing Welcome2France, through the Site, Application, and Services, your Third-Party Account login information; or (ii) granting Welcome2France access to your Third-Party Account, as permitted under applicable terms and conditions that govern the use of each of your Third-Party Accounts. Should you opt to do so, you represent and warrant that you are entitled to disclose your Third-Party Account login information to Welcome2France, and/or to grant Welcome2France access to your Third-Party Account, without you breaching any terms and conditions that govern the use of each of your Third-Party Accounts, and without obligating Welcome2France to pay any fees or making Welcome2France subject to any usage limitations that third-party service providers impose. By granting Welcome2France access to any Third-Party Accounts, you understand that Welcome2France will access, make available, and, where applicable, store any Content you provide and store in your Third-Party Account (“SNS Content”), so that it is accessible and available on and via the Site, Application, and Services via your Welcome2France account and Welcome2France Account profile page. Unless otherwise specified in these Terms, any or all SNS Content will be considered Member Content for purposes of these Terms. Depending on the Third-Party Accounts you choose to link to your Welcome2France Account, and subject to the privacy settings you have made for these Third-Party Accounts, your personally identifiable information posted in your Third-Party Accounts will be made available on and through your Welcome2France Account on the Site, Application, and Services. Please note that if a Third-Party Account or any associated service becomes unavailable, or if Welcome2France’s access to such Third-Party Account is terminated by the third-party service provider, then the SNS Content will no longer be available on and through the Site, Application, and Services. You have the option to disable the link between your Welcome2France Account and your Third-Party Account/s at any time, and you may do so by accessing the “Settings” section of the Site and the Application. PLEASE NOTE THAT YOUR RELATIONSHIP WITH ANY AND ALL THIRD-PARTY SERVICE PROVIDERS ASSOCIATED WITH YOUR WELCOME2FRANCE-LINKED THIRD-PARTY ACCOUNTS IS GOVERNED SOLELY AND WHOLLY BY YOUR AGGREEMENT/S WITH THE THIRD-PARTY SERVICE PROVIDER/S. Welcome2France does not make any effort to review any or all SNS Content for any purpose, including, but not limited to, accuracy and legality, and Welcome2France is not responsible for SNS Content.

Your Welcome2France Account and its corresponding profile page will be created for your use of the Site, Application, and Services, and these will be based upon the personal information you provide directly to us or via the SNS Content, as described above. You may not have more than one (1) active Welcome2France Account. You hereby agree to provide accurate and complete information during the account-creation and registration process, and you also hereby agree to update such information to make it stay current. Welcome2France reserves the right to suspend, cancel, or terminate your Welcome2France Account, as well as your access to the Site, Application, and Services, if you create more than one (1) Welcome2France Account, or if any information you provide during and after the account-creation and registration process proves to be fraudulent, inaccurate, incomplete, obsolete, not current, or otherwise in violation of these Terms.

You expressly agree that you are solely responsible for safeguarding your password. You also expressly agree that you will not, at any time, disclose your password to any third party.

Unless expressly authorized by a specific Welcome2France feature or functionality, you are not permitted to share your Welcome2France Account with any person or establishment, and you are not permitted to give others access to your Welcome2France Account. Welcome2France may, using our sole discretion, enable features and functionalities that allow other Members to take certain actions pertaining to your Welcome2France Account, on your behalf and with your express authorization, such as enabling your executive assistant, colleague, employer, or travel agent to book an Accommodation on your behalf, or, for Hosts, adding a family member to your Welcome2France account as an additional Host. You expressly agree that you will take full and sole responsibility for any activity or action performed in and through your Welcome2France Account, whether or not you have authorized such activity or action. You will immediately notify Welcome2France of any unauthorized access or use of your Welcome2France Account.

Accommodation Listings

As a Member, you are permitted to create Listings. To create a Listing, you must answer a range of questions about the Accommodation you plan to list, and these questions include the location, size, capacity, features, availability, pricing, rules, and related financial terms. To be featured in Listings, each Accommodation must have a valid physical address. All Listings will be publicly viewable on the Site, Application, and Services. You understand and agree that the ranking or placement of the Listings in the search results depend on a variety of factors, such as Host preferences, Guest preferences, Guest ratings, and ease of Booking.

Other Members will be able to book your Accommodation through the Site, Applicaiton, and Services, based on the information that you have provided in your Listing, your Guest requirements, and the prospective Guests’ preferences and search parameters. You understand and agree that once a Guest requests a Booking of your Accommodation, you are not allowed to request the Guest to pay a higher price than what is stated in the Booking request.

You completely acknowledge and fully agree that you are solely responsible for any and all of the Listings and Member Content that you post. As such, you represent and warrant that any Listing you post, the Booking of an Accommodation in a Listing you post, or a Guest’s stay at an Accommodation in a Listing you post: (i) will not breach any agreements you have entered into and signed with any third parties, such as the homeowners’ or condominium association in which the Accommodation belongs; and (ii) will (a) comply with zoning laws, intellectual property laws, and/or other applicable laws, Tax requirements, business permits and related requirements, and rules and regulations governing any Accommodation in a Listing you post, and (b) not be in conflict with the rights of any third party. Please note that Welcome2France assumes no responsibility for a Host’s compliance with any applicable laws, related rules and regulations, and/or agreements with and obligations to third parties. Welcome2France reserves the right to remove or disable access, at any time and without prior notice, any Listing for any reason, including Listings that Welcome2France considers, at its sole discretion, to be objectionable for whatever reason or to be harmful to the Site, Application, and Services. Welcome2France also reserves the right to remove or disable access, at any time and without prior notice, any Listing for any reason, including Listings that Welcome2France considers, at its sole discretion, to be in violation of the Terms or of Welcome2France’s standing Policies and Community Guidelines or Standards, and Trademark and Branding Guidelines.

If you are a Host, you completely understand and fully agree that Welcome2France does not act as an insurer or contracting agent for you or anyone. If a Guest requests a Booking of your Accommodation and actually stays at your Accommodation, any agreement you enter into with such Guest is solely between you and the Guest, with Welcome2France not being a party to it.

When you create a Listing, you may opt to list down certain requirements that must be met by the Members, in order for them to be eligible to request a Booking of your Accommodation, and these requirements may include a Welcome2France Account profile page photo or a verified telephone number. More information on how to set these requirements is available in the “Hosting” section of the Site, Application, and Services.

Welcome2France makes certain tools available to Hosts, and if you are a Host, these tools will help you make informed decisions on which Member Booking you will approve and confirm. You fully acknowledge and agree that as a Host, you are solely responsible for your own acts and omissions pertaining to the Accommodations included in your Listings. You also fully acknowledge and agree that as a Host, you are solely responsible for the acts and omissions of any individuals whom you have allowed to reside at, or be present in, the Accommodations included in your Listings, unless the acts and omissions are made by the Guest or the individuals invited by the Guest to the Accommodation.

Welcome2France recommends that Hosts obtain appropriate insurance coverage for their Accommodations. Please carefully and thoroughly review any insurance policy that you consider taking out for your Accommodation, and make sure that you fully understand each exclusion and applicable deductible, including, but not limited to, actions or inactions of Guests and their invited visitors during their stay at your Accommodation. Please also carefully and thoroughly review any insurance policy for your Accommodation, to see whether or not this interacts with the Welcome2France Host Protection Insurance Program to the extent that is provided in your jurisdiction.

Welcome2France may offer Hosts the option to have photographers take photographs of the Accommodations in their Listings. If you as a Host choose to enlist the services of a photographer, Welcome2France shall own all copyrights of the photographs taken and thus have a right to put a watermark or tag, which bears the label “Welcome2France Verified Photo” or similar words (“Verified Images”); however, Welcome2France will allow you to use these, with the appropriate watermark or tag, for your Listings. You agree that you, and you alone, are responsible for ensuring that each one of your Listings is accurately and honestly represented in the Verified Images. You, and you alone, are responsible for the use of the Verified Images to showcase your Listings, and you warrant that you will cease to use any or all of these Verified Images, or any related images, as soon as these cease to represent your Listings accurately or once you cease to be the Host of the Accommodations in the Listings. All materials and content created by these photographers with respect to the Verified Images shall constitute Welcome2France Content, even if you do not include these in your Listing, and you agree that you will not use these outside of your Listing without prior authorization and express written permission from Welcome2France. If your Welcome2France Account is suspended, cancelled, terminated for whatever reason, you shall not use the Verified Images in any way. You expressly agree that Welcome2France retains its right to use the Verified Images for marketing, advertising, commercial, and other business purposes in any platform or medium, whether or not in relation to your Listing, and without further notice or compensation to you.

No Endorsements or Preferential Treatment

Welcome2France does not endorse any Member, Accommodation, or Listing. You fully understand that Verified Images are intended only to provide a photographic representation of a part of the Accommodation at the time the photographs were taken. Verified Images are, therefore, not a form of Welcome2France endorsement of any Member, Accommodation, or Listing.

Members are required by these Terms to provide complete, current, and accurate information. For transparency, fraud-prevention, fraud-detection, and similar purposes, Welcome2France may ask you to furnish certain forms of government identification with your date of birth and/or other personal information, and it may also ask you to undergo certain checks and processes that will help verify your identity or background as a Member. Welcome2France may also countercheck Member information with third-party databases or other sources. Welcome2France does not, however, make any representations about, confirm, or endorse any Member or the Member’s claimed identity or background.

By registering for a Welcome2France Account, you agree that Welcome2France may, but is in no way obliged or compelled to, request a consumer report on you from a consumer reporting agency.

Any references in the Site, Application, or Services to any Member being “verified” or “connected” (or similar wording) only indicate that the Member has performed and completed a relevant identification and/or verification process with respect to Welcome2France Account activities, and these actions do not indicate or represent anything else. Any such description does not constitute a Welcome2France endorsement, certification, approval, or guarantee on a Member or a Member’s identity, and it does not define the Member as safe or trustworthy. Any such description is only intended to help you evaluate a Member when you make your decision on which persons to interact with on the Site, Application, and Services. Welcome2France recommends that you always exercise care, caution, and due diligence when deciding whether to book an Accommodation, stay with a Host, pre-approve or accept a Booking Request, interact with a Guest, or transact with other Members. Except as provided in the Welcome2France Host Guarantee Terms and Conditions (“Welcome2France Host Guarantee”), which is an agreement between Welcome2France and hosts, Welcome2France is not responsible for any inconvenience, damage, or harm resulting from your communication, interaction, or transaction with other Members.

By using the Site, Application, or Services, you fully agree that any legal remedy or liability that you seek to obtain for any acts or omissions of other Members or third parties will be limited to a claim against the particular Members or third parties who have caused you inconvenience, damage, or harm. You also fully agree not to attempt to impose any liability on, or seek legal remedy from, Welcome2France on such acts or omissions. Accordingly, Welcome2France encourages you to communicate directly with other Members regarding the Bookings or Listings that concern you. This limitation shall not apply to a claim by a Host against Welcome2France with regard to the remittance of payments received from a Guest by Welcome2France on behalf of a Host that shall be subject to the limitations described in the “Limitation of Liability” section below.

Bookings and Financial Terms

Definitions

“Accommodation Fees” refers to the monetary amounts that are due in exchange for stay at an Accommodation, and which is payable by a Guest staying at the Accommodation. The Hosts, and not Welcome2France, are fully responsible for the Accommodation Fees for their respective Listings. The Hosts may in their sole discretion include in these monetary amounts (i) cleaning or other fees permitted on the Welcome2France platform, and/or (ii) Taxes that the Hosts deem fit to collect from their Guests.

“Guest Fees” refers to the monetary amounts that Welcome2France charges a Guest for the use of the Site, Application, and Services with respect to their Booking of Accommodations. The Guest Fees are a percentage of the monetary amounts calculated by Hosts as Accommodation Fees, and these will be displayed when Guests go to the page where they are asked if they wish to send Booking Requests to the respective Hosts.

“Host Fees” refers to the monetary amounts that Welcome2France charges a Host for the use of the Services. The Host Fees are a percentage of the monetary amounts calculated by Hosts as Accommodation Fees.

“Payment Method” refers to the means by which a Guest sends the fees in exchange for Booking an Accommodation through Welcome2France. Guests add to their Welcome2France Account their preferred Payment Method, such as a credit card, debit card, or PayPal account.

“Service Fees” refers to both the Guest Fees and the Host Fees.

“Total Fees” refers collectively to the Accommodation Fees, Guest Fees, and any Taxes.

Booking and Financial Terms for Hosts

Whenever a Booking is requested through the Site, Application, or Services, the Host of the Accommodation is required to pre-approve and confirm, or otherwise reject, the Booking Request within the Booking Request Period; otherwise, the Booking Request will automatically expire. Whenever a Booking Request is made through the Site, Application, or Services, Welcome2France will share with you (i) the first and last name of the Guest making the Booking Request, (ii) a link to the Guest’s Welcome2France Account profile page, (iii) the names of any shared SNS connections, if the Guest and the Host have each connected their Welcome2France Account to SNS and have allowed the sharing of social connections, an (iv) an indication that the Guest has provided Welcome2France other information, such as a government ID, a verified e-mail address, or an SNS connection. Should a Host be unable to decide whether to confirm or to reject a Booking Request within the Booking Request Period, any monetary amounts collected by Welcome2France will be refunded to the paying Guest. When a Host confirms a Booking, Welcome2France will send a Communication that confirms such Booking, depending on the selections and settings made by the Host on the Site, Application, and Services.

Welcome2France will collect the Total Fees from Guests during the Booking Request or as soon as the Host confirms the Booking. Welcome2France will subsequently pay the Host the Accommodation Fees (less any applicable fees and taxes), as further described in the Payments Terms.

In accordance with the cancellation policy selected and set by the Host, and reflected in the relevant Listing, each and every Host agrees that Welcome2France may (i) allow the Guest to cancel the Booking, and (ii) refund the Guest, through Welcome2France Payments, a portion of the Accommodation Fees, as specified in the applicable cancellation policy.

Booking and Financial Terms for Guests

The Host, not Welcome2France, is solely responsible for honoring confirmed Bookings and making available the Accommodation that a Guest has reserved through the Site, Application, or Services. If a Guest chooses to transact with a Host for the Booking of an Accommodation, you completely understand and fully agree that you will be required to sign onto an agreement with the Host, and that you will accept all terms, conditions, rules, regulations, and restrictions imposed by the Host in relation to the Accommodation.

You understand, acknowledge, and agree that you, and not Welcome2France, are solely responsible for the performance of obligations of any agreements entered into with the Host, with respect to the booked Accommodation. You also understand, acknowledge, and agree that Welcome2France is not in any way a party to such an agreement, and that, with the exception of Welcome2France Payments’ obligations in accordance with the Payment Terms, Welcome2France (and all of its subsidiaries) disclaims any and all liability that may arise from such agreement.

The Total Fees payable by the Guest will be displayed in the Guest’s relevant Welcome2France Account page before the Guest sends a Booking Request to the Host. As mentioned above, the Host is required to pre-approve and confirm, or otherwise reject, the Booking Request within the Booking Request Period; otherwise, the Booking Request will automatically expire. Upon receiving the Guest’s Booking Request, Welcome2France may provide a pre-authorization and/or charge a nominal amount to the Guest’s Payment Method, as laid out in the Payments Terms. If a requested Booking of Accommodation is not confirmed by the Host, and thereby cancelled, any amounts collected by Welcome2France Payments will be refunded to the Guest, depending on the selections and settings made by the Guest on the Site, Application, and Services. In this case, and if applicable, any pre-authorization of the Guest’s Payment Method will be released.
